Important: Please ensure that all members of your party have been made aware of the following conditions. These Terms and Conditions apply to the transaction detailed on this documentation. Your acceptance of these conditions is a term of supply of the Services. By paying for and accepting supply of the Service, you agree to be bound by these conditions. 1. Definitions: Service refers specifically to the hot air ballooning mentioned on this documentation and generally to the range of products provided by the tour operator, including accommodation and customised activities arranged by agreement. Service Operator refers to the tour company named on your confirmation or any independent contractor supplying/delivering the services to you under the your Agreement with the tour operator. 2. Liability Under no circumstances will The Tour Operator be liable for direct, indirect, consequential or incidental damages including but not limited to lost or damaged property, lost profits or savings or damages for disappointment. The Tour Operator may arrange for the hot air ballooning to be performed under a ‘code-sharing’ arrangement, i.e. it may subcontract another ballooning company to provide you with your flight. In such instances, The Tour Operator accepts no liability in connection with such services or for any loss, injury, or damage to or in respect of any person or property. The Tour Operator reserves the right to alter contents of products and location when deemed necessary. The Tour Operator does however warrant providing services of equal nature and value. 3. Alteration and Cancellation of a Booking In the unfortunate event you should have to alter/cancel your booking, certain fees & conditions apply: If you wish to ALTER your flight booking: If you wish to CANCEL& receive a refund: Within 48 hours prior to a weekday flight, no changes are permitted. Between 48 hours and 7 days prior to a weekday flight - a $50 per person rebooking fee will be charged; your flight will need to be re-scheduled on a weekday flight only, excluding public holidays. 7 days or more prior to a weekday flight – a $25 per person rebooking fee will be charged. You will lose the full cost of your flight if you fail to show up for your flight. You may send someone else in your place if you wish – please let us know the name of the replacement person before the flight. You cannot receive a refund on any trips booked using a gift certificate. (See Section 4) NB: Separate cancellation and alteration provisions apply to large groups and customised events. These are specified on the group booking documentation supplied. The Tour Operator reserves the right to amend these fees and notice periods. When special circumstances arise, some of these Terms and Conditions may be superseded by those published on your booking confirmation documentation. 4. Gift Certificates Gift certificates are valid only when fully paid by the purchaser or distributor. Gift Certificates cannot be redeemed for cash or refunded in part or full. Certificates are transferable to other individuals and are valid only for the period indicated thereon. Once the certificate has been redeemed (i.e. the trip date has been booked) all other terms relating to Alteration and Cancellation (see Section 3) apply, however the value remains non-refundable. Should you need to extend the validity of your gift certificate beyond the normal 12 months, reinstatement fees apply: $50 – 6 month extension; $100 - 12 month extension. 5. Weather, Mechanical, Staffing Other Safety ConditionsHot air ballooning relies on suitable weather conditions in order to proceed safely. Information on specific weather considerations are provided for at the time of making the booking. Additionally, flights may be dependant on mechanical performance or staffing availability. When conditions are deemed by The Tour Operator to be unsuitable or unsafe to proceed, then trips may not go ahead on the scheduled date. Similarly a trip may be postponed due to less than minimum numbers being achieved. Our Melbourne flights may not always fly over the central business district (CBD/city area). Whilst our pilots will endeavour to fly as close to the CBD as possible, our flight path is determined by the most up to date meteorological conditions to ensure the safest possible flight for all concerned. In the unfortunate event that a Service must be delayed, rescheduled or cancelled due to any of the above factors, The Tour Operator will hold payment in credit and offer alternative booking dates. Any request for refund will be treated as per cancellation terms listed in Section 3 above. The Tour Operator will not accept any liability for travel, accommodation, inconvenience or other costs incurred or lost through such cancellation. International, interstate and country visitors should factor the possibility of short notice cancellation. 5. Rebooking Your Flight If your flight has been cancelled due to inclement weather conditions, please contact our office as soon as possible to rebook. Payment received for your flight will be held in credit and applied to the rebooking. Rebooking must be done within 12 months of the first cancelled flight date. There will be no refunds for bookings held on our system for longer than 6 months. 6. Discounted bookings Any discounts or special offers are only available on the full recommended retail price and are not valid in conjunction with any pre-existing discounts or seasonal specials. Any bookings made using a discount or special offer are non-refundable. Bookings are transferable to other individuals and are valid only for the period indicated thereon. All terms relating to Alteration and Cancellation (see Section 4) apply, however the value remains non-refundable. Should you need to extend the validity of your booking beyond the normal 12 months, reinstatement fees apply: $50 - 6 month extension; $100 - 12 month extension. 8. Your Responsibility (a) It is your responsibility to ensure you have received booking confirmation details of your flight; please notify the The Tour Operator office immediately and prior to your flight date if you do not have this information. You are also required to follow the check-in procedure outlined in the confirmation letter the evening before your flight. If you do not contact the duty pilot as required between 6.30 and 7.00 p.m., The Tour Operator cannot be held liable for the consequences of not checking in with your pilot and receiving the latest instructions. (b) In the interests of safety, you undertake to follow the advice of the pilot and ground crew, comply with any local codes of conduct and act sensibly and prudently at all times. You also agree to indemnify The Tour Operator, its owners, officers and employees for all losses and/or damage arising from any act or default on your part or the part of a member of your party. Under no circumstances at any time during supply of the Services should you or a member of your party be under the influence of drugs or alcohol, nor should you take medication that could affect or impair your judgment at this time. (c) Check with your medical practitioner if you have a pre-existing medical condition that may be affected by the physical nature of hot air ballooning. You agree to indemnify The Tour Operator, its owners, officers and employees against any incident related to your health occurring during or after supply of the Services. (d) Personal belongings taken on board are at your own risk. (e) Ballooning is an outdoor adventure activity, and The Tour Operator cannot be held liable for damage to any clothing.

By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice. Dates, itineraries and prices are valid from 01 May 2014 until 30 June 2017. If booking through a third party you may be required to pay a deposit for your booking. Recovery of this amount in the event of non-participation for whatever reason will be subject to the booking agents policies and may be non-recoverable. Bookings made direct to us do not require a deposit. Acceptance of your booking will be confirmed by email and text. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due no later than immediately prior to departure on the day of trip. If this balance is not paid on or before this time we reserve the right to treat your booking as cancelled and you will be unable to participate in the tour for that day. In order for us to confirm your travel arrangements you must provide all requested details and the deposit (if required) at the time of booking. Necessary details include full name, age, nationality, any relevant pre-existing medical conditions (which may affect your ability to complete your travel arrangements or participate in our adventures), contact details, pickup location, food allergies and considerations. If you wish to transfer from one trip to another or transfer your booking to a third party we require that you notify us at least 48 hours in advance of departure time to discuss and make arrangements where possible. If late for pickup we will attempt to contact you by the phone number. In the advent that you are unreachable and more than 10 minutes late it will be assumed that you are not attending and your seat will be cancelled. Any monies taken will be forfeit in this situation. Booking direct. o In the case of private charter payment will be required prior to departure date. This will be advised in your tour documentation. o For standard tours no reservation fee will be payable in this instance and payment can be made on the day. 2. Cancellation of Trip Cancellation by the traveler a. Refunds from cancelled trips will be paid out according to the table below. Ethical Adventures NT reserves the right to take into account mitigating circumstances of your situation and may increase the refund amount where it deems appropriate. Time to Departure Refund More than 48 hr: 100% 24-48 hr: 50% Less than 24 hr: 0% b. In all instances the refund provided by Ethical Adventures will be that portion of payment which we received. Any monies paid to third parties such as booking agents is not covered by our refund policy. It is your responsibility to pursue that refund from them directly subject to their Terms & Conditions. 2. If We (Ethical Adventures NT) Cancels a. Ethical Adventures NT may cancel a trip due to logistical or operational issues, insufficient sign-ups or any other cause that makes the trip unfeasible for us to operate. You will be advised as soon as practicably possible by Ethical Adventures NT staff. If we cannot facilitate your trip then we will endeavour to place you with another operator of our choosing. If we do not find an alternative for you that is acceptable to you and us you will receive a full refund performed via internet transfer of funds or cash payout. This amount will include any reservations monies paid to third parties such as Booking Agents for your tour with Ethical Adventures NT. This will constitute full settlement. b. We may also cancel departures if forced to do so by circumstances such as fire, cyclones, industrial action etc. or what is commonly referred to as force majeure. 3. Force Majeure (FM) a. In the case of FM and Ethical Adventures NT is forced to cancel a trip we will follow the ‘normal’ If We Cancel Policy above (2b). If you are unable to attend a tour due to FM and are forced to cancel then you will likewise be treated according to the same policy (2b). 3. Complaints & Endorsements Ethical Adventures NT relies on your feedback to ensure that all aspects of our adventures are to the highest standard and to help us achieve our goals, leaving you more than satisfied. For this reason we encourage you to contact us via our email address and/or leave comments on our social media sites. Included in this are FACEBOOK, TRIP ADVISOR and LINKEDIN. Our choice to use online forms rather than paper forms reflects our commitment to maintaining a minimalistic paper use business. 4. Pricing & Payment Our prices are based on Australian Dollars at the time of booking confirmation. All payments are to be made in Australian Dollars. Prices are set to achieve what we think is a breakeven point between the costs of running the tours and expected income. They are not designed to make a substantial profit. They do include GST. We do not accept credit cards directly but do provide that option on our website booking window. Preferred payment is by Bank Transfer or Cash on the day. Bank details will be provided on request at time of confirmation of booking or payment can be made on the day immediately prior to departure in cash. 5. Age & Disability Limitations All travellers under the age of 18 must be accompanied by an adult who is responsible for the child's behaviour whilst on tour. Children under 8 years of age are not suitable for our open set tours and as such will not be accepted for any set tour.When booking a charter tour it is possible in some circumstances to accommodate children under the age of 8 years old. This can be discussed at time of booking. There is no upper limit for our adventures however due to the nature of the terrain and weather conditions we reserve the right to refuse on the day any passenger who we deem unable to fully and safely participate in that tours activities. In this case the passenger will be subject to Refund Policy (2b). As a rule of thumb you should be able to skip for 5 metres continuously without undue stress. There are no age restrictions associated with Chartered Tours however fitness and flexibility levels outlined in 5(b) above still apply. 6. Travel Insurance Travel insurance is highly recommended. Your travel insurance should cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of AUS$200,000 for each of the heads of cover. 7. Change of Itinerary Due to the nature of the environment and location of our adventures we may be required to alter the itinerary as previously represented with little or no prior notice being given to you. We will however attempt to inform you prior to departure as soon as is reasonably possible and offer to reschedule you on another trip or refund your payment if the changes are not to your liking. We also reserve the right to alter the itinerary on any tour if in our view a better experience would be achieved by doing so. We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. 8. Local Law & Authority on tour Our adventures generally occur in remote, ecological important and culturally sensitive environments. For these reason and more all participants must act in accordance with local law and within the acceptable bounds of local customs whilst maintaining safety of all participants. Your guide will have final say on all matters likely to affect the safety or well-being of any person participating in the trip or the integrity of the locality. If you fail to comply with a decision made by your guide, or interfere with the well-being of the group, the group leader may order you to leave the trip immediately, with no right of refund. 9. Acceptance of risk You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the fauna, flora and geographical attributes present dangers and physical challenges greater than those present in our daily lives. However it is also your own responsibility to acquaint yourself with all possible relevant travel information and safety related information which will help you on your adventure with us. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks attendant upon such travel. 10. Limitation of Liability We may contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law: any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded; you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded. To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute diiscretion) the provision of a similar trip to an equivalent value; or a refund of the total amount received by us from you in connection with your booking. Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages 11. Optional Activities Any activities not normally forming part of our adventures are not included in this contract. Although these may have been undertaken during our tour timeframe and via assistance from your guide you accept that any assistance given by your guide in arranging optional activities does not render us liable for them. 12. Errors & Omissions We here at Ethical Adventures NT have made every effort to ensure that the content of this site is correct. However we cannot guarantee that we have not made mistakes so please bear that in mind as you scroll through the pages. We apologise for this and welcome your input to correct our oversight. By using this site, you acknowledge and accept that there may be errors in content and all information is provided for your interest only such that to the fullest extent permitted by law, Ethical Adventures and its employees will not be held responsible or liable for any loss, damage or other problems arising from use of, or inability to use, this site. Likewise links to third party sites are provided for your (the user) convenience. Although Ethical Adventures NT may have found these sites useful, reliable and trust worthy for our own purposes we cannot and do not endorse them, their policies, procedures, content or services. The use of this website and these terms are subject to the laws of Australia and the jurisdiction of the Australian courts. 13. Feedback Ethical Adventures relies on your feedback to ensure that all aspects of our adventures are to the highest standard, achieve our goals leave you more than satisfied. For this reason feedback forms are provided and encouraged to be completed by you so that we can address any issues, improve our products and take heart from your satisfied words. Where a complaint has been lodged then Ethical Adventures NT will investigate the cause and seek to remedy the situation. In such cases you (the plaintiff) will be contacted to be informed of changes or the outcome of the complaint. 14. Severability In the event that any Term or Condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such Term or Condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding. 15. Photos and Marketing By participating in our Adventures you consent to Ethical Adventures NT using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes If at the time of booking the trip you wish to void the consent given in 15(a) you will be required to state this in an email clearly stating ‘I do not give permission to use my image for any marketing material associated with Ethical Adventures NT’ at the time of booking. No exceptions. 16. Privacy Policy Any personal information given to Ethical Adventures NT will remain private. Any personal information gathered will never be sold to any third party for any reason. Ethical Adventures NT only collects personal information from visitors in order to process requests initiated by that person or there representative in order to perform a booking, payment or feedback. We may provide your details to our agents in order to facilitate your requested services from us. Once your transaction with Ethical Adventures NT is completed you can request your personal details be deleted from our records. You may be contacted by Ethical Adventures in the future in regards to its activities. If you do not wish this to occur clearly state ‘ I do not wish to be contacted by Ethical Adventures NT in the future’ and we will delete your details from our records and only respond to your communications. 17. Applicable Law The laws of the Northern Territory, Australia govern these Booking conditions and any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the Northern Territory, Australia. 18. Kotahi Tourism:

KOTAHI TOURISM TERMS & CONDITIONS Kotahi Tourism accepts your booking subject to the following terms and conditions. Please ensure you read carefully and understand these terms prior to confirming your booking. 1. Booking Your booking is confirmed on receipt of payment. All participants must confirm bookings in advance. Kotahi Tourism recommends booking early to avoid disappointment. Prices are per person in Australian dollars. GST is not applicable. Tickets are transferable. Please notify Kotahi Tourism of the new participant. Once the tour has departed no portion of the payment is refundable, no exceptions. Third Party Bookings Booking vouchers must be shown when booking is made through a third party booking agent (“Reseller”). Participants who purchased the tour through a Reseller are subject to the conditions of the booking agent. 2. Cancellation Policy Cancellations will result in the following: More than 30 days notice: Full refund of the Tour Fee Less than 30 days notice and more than 24 hours notice: 50% refund of the Tour Fee Less than 24 hours notice: No refund No refunds are payable to persons booking with a gift voucher. Kotahi Tourism reserves the right to cancel or reschedule the tour in cases of extreme weather or dangerous conditions that are not within the control of the guide or Kotahi Tourism. Tours will still proceed if it is raining. 3. Gift vouchers Gift vouchers are not redeemable for cash and must be used prior to the expiry date. Participants using a gift voucher must ensure they are booked on a tour in order for gift vouchers to be redeemed. 4. Conduct Kotahi Tourism reserve the right to stop any Participants from continuing the tour if they breach our safety standards, or if the participant is behaving in an unacceptable manner or affected by any substance. Any person who is expelled from the Tour on this basis will forfeit the Tour Fee. 5. Safety The tour route includes walking up and down stairs, over uneven ground and crossing busy intersections - "the activities' Due to the nature and extent of the activities, you warrant that: a. You are physically and mentally able to undertake the activities; b. You have no pre-existing condition that may be affected by the activities; and c. You have adequate and appropriate footwear and clothing for the activities. You understand and agree to accept full responsibility for your own safety and wellbeing during the tour. This includes paying due care and attention to traffic, pedestrians and other potential obstacles and dangers. Kotahi Tourism accepts no liability whatsoever for any loss or injury incurred as a result of participation in the tour to the extent permitted by law. In the event that any statute prevents liability being excluded or modified then this clause shall be interpreted as applying only to such liability that can be excluded or modified by agreement between the parties. Kotahi Tourism accepts no liability for any loss or damage to your personal property while on the tour, including but not limited to personal belongings, valuables, photographic equipment or clothing. 6. Indemnity You agree to indemnify Kotahi Tourism from and against any claim by a third party for loss or damage (and the legal costs incurred in defending the same) arising out of your conduct while participating in the Tour, or due to any breach of these Terms and Conditions. Kotahi Tourism is not liable for any loss, damage or inconvenience arising from or incidental to any delay in the scheduled tour taking place. Any loss or damage to third party property is solely your responsibility. 7. Miscellaneous Terms (a) All Participants acknowledge and agree that that Kotahi Tourism is expressly authorised to take photographs of Participants during the tour and utilise such photographs for the purpose of promoting Poihakena Tours including but not limited to being displayed on the Kotahi Tourism website. (b) Photographs remain copyright to the Company and may only be used or reproduced by Participants for private or domestic purposes and must not be used for any commercial purpose, including promotion of any supplier or any supplier's products or services, without the Company’s prior written permission. 8. Governing Law These Terms are governed by the laws of New South Wales, Australia. Kotahi Tourism and each Participant submit to the non-exclusive jurisdiction of the Courts of New South Wales in respect of these Terms and any dispute between them.

Explore Australia will not be held responsible for guests failing to familiarise themselves with the booking terms and conditions. Cancellations within 48 hours or failure to board on the day of tour, will result in 100% full fare forfeiture. No changes can be made within 48 hours of departure; however, you can transfer your booking to another person, and we must be advised of the name change.
